This Privacy Policy explains what information Floor Nexus collects, why we collect it, how we use and protect it, and what rights you have. By using the Floor Nexus platform, you agree to the practices described in this Policy. Please read it carefully.

01Who We Are

Floor Nexus, Inc. is a Florida-based software company that operates a cloud-based SaaS platform built exclusively for the resin/epoxy flooring, decorative concrete, and surface coating industry. Our platform connects flooring contractors and installers, manufacturers and vendors, and property owners through a suite of business management, quoting, estimating, and marketplace tools.

For the purposes of this Privacy Policy, "Floor Nexus," "we," "us," or "our" refers to Floor Nexus, Inc. "You" or "User" refers to anyone who accesses or uses our Platform in any capacity, including Installer Users, Vendor Users, and Homeowner Users.

02What Information We Collect

2.2 Information Collected Automatically

When you access the Platform, we and our service providers automatically collect certain technical data, including:

  • IP address, browser type and version, operating system, device type
  • Pages visited, features used, time spent on pages, click paths
  • Referring URLs and exit pages
  • Session identifiers and authentication tokens
  • Error logs and crash reports
  • Visualizer usage data (number of renders generated per account, per billing period)

2.3 Information from Third Parties

We may receive information about you from third parties, including:

Payment processors (Stripe, Square, Swipe Aras)
Transaction status, payment method type (not full card numbers)
Google Calendar
Calendar event data you choose to sync with your Floor Nexus calendar
QuickBooks
Accounting data you authorize us to access for integration purposes
Social login providers
If you sign in via a third-party account, we receive your public profile information from that provider

03How We Use Your Information

We use the information we collect for the following purposes:

Providing the Service
To register and maintain your account, process estimates and invoices, enable job management tools, power the Marketplace, and deliver all core Platform functionality.
Quote Builder & Homeowner Portal
To route homeowner quote requests to the appropriate contractor, display project visualizations, and facilitate contractor-homeowner communications.
Billing & Payments
To process subscription fees, manage billing cycles, handle payment disputes, and issue invoices for Platform use.
Communications
To send transactional emails (receipts, account alerts, password resets), platform updates, and, where you have consented, marketing communications.
Platform Improvement
To analyze usage patterns, identify bugs, improve existing features, and develop new tools based on how users interact with the Platform.
Security & Fraud Prevention
To detect, investigate, and prevent unauthorized access, fraudulent activity, abuse, and other harmful conduct.
Legal & Compliance
To comply with applicable laws and regulations, enforce our Terms of Service, respond to legal requests, and protect the rights, property, and safety of Floor Nexus and our users.
Support
To respond to your inquiries, troubleshoot issues, and provide account assistance.
AI-Powered Features
To power the Floor Nexus Visualizer and any other AI-assisted tools within the Platform.
Floor Nexus does not use your personal information, uploaded photos, project data, or User Data to train generalized or public AI models. Any AI subprocessors we work with are contractually limited to using your data solely to deliver the specific feature you are using, nothing more.

04How We Share Your Information

We do not sell your personal information. We share information only in the following limited circumstances.

4.1 Service Providers

We engage trusted third-party vendors who process data on our behalf to help us operate the Platform:

All service providers are contractually obligated to use your data only for the purposes we specify and to maintain appropriate security standards.

4.2 Within the Platform — Contractor/Homeowner Connections

When a homeowner submits a quote request through Quote Builder, their contact information and project details are shared with the contractor(s) they are matched with or who they directly contact. Homeowners consent to this sharing at the time of submitting their request.

4.3 Within the Platform — Vendor/Contractor Connections

Vendors who list products in the Floor Nexus Marketplace have access to order details and purchasing contractor information necessary to fulfill orders.

4.4 Legal Requirements

We may disclose your information if required to do so by law, court order, subpoena, or government regulation, or if we believe disclosure is necessary to protect the rights, property, or safety of Floor Nexus, our users, or the public.

4.5 Business Transfers

If Floor Nexus is involved in a merger, acquisition, financing, or sale of company assets, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

4.6 With Your Consent

We may share your information for any other purpose with your explicit prior consent.

05Payment Processing

Floor Nexus uses third-party payment processors — including Stripe, Square, and Swipe Aras — to handle all payment transactions. This includes both your subscription payments to Floor Nexus and payments your clients make to you through the Platform.

  • We do not store your full credit card numbers, CVV codes, or bank account numbers on our servers. This data is transmitted directly to and stored by your chosen payment processor in accordance with PCI-DSS standards.
  • We may store non-sensitive payment metadata, such as the last four digits of a card, card brand, expiration date, and payment status, for display and account management purposes.
  • Transaction fees and processing rates associated with payments made through the Platform are disclosed during processor setup and may vary by processor and transaction type.
  • Your use of any payment processor is also governed by that processor's own terms of service and privacy policy.

06SMS, Text Messaging, and Communications

Floor Nexus may send text messages (SMS) to your mobile phone number for purposes such as account notifications, appointment reminders, quote alerts, and platform updates — but only with your prior express consent.

SMS Consent & Opt-Out: By providing your phone number and opting in to SMS communications, you consent to receive text messages from Floor Nexus. Message and data rates may apply. You may opt out at any time by replying STOP to any text message. To opt back in, reply START. For help, reply HELP or contact us at [email protected].

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of text message delivery services required to deliver your messages.

All SMS communications from Floor Nexus will identify us as the sender. We will not send unsolicited marketing texts. Frequency of messages will vary based on your account activity and notification preferences.

07Cookies and Tracking Technologies

We and our service providers use cookies, web beacons, local storage, and similar technologies to operate and improve the Platform. These help us:

  • Keep you logged in and maintain your session
  • Remember your preferences and settings
  • Understand how users interact with the Platform
  • Detect and prevent fraud and unauthorized access
  • Measure the effectiveness of features and improvements

You may control cookie behavior through your browser settings. Note that disabling certain cookies may prevent some Platform features from functioning correctly. We do not respond to browser "Do Not Track" signals at this time, as there is no universally accepted standard for doing so.

08Data Storage and Security

Your data is stored on servers hosted by Amazon Web Services (AWS), located in the United States. File uploads — including job photos, project documents, and product images — are stored in AWS S3.

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your information. These include:

  • Encrypted data transmission (TLS/HTTPS) for all Platform communications
  • Encrypted storage of sensitive data at rest
  • Access controls and role-based permissions limiting employee access to user data
  • Regular security reviews and monitoring

Despite our safeguards, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security. If a data breach occurs that affects your rights, we will notify you as required by applicable law.

09Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal obligations (including Florida's Information Protection Act), to resolve disputes, and to enforce our agreements.

Active accounts
Data is retained for the full duration of your account and subscription.
Cancelled accounts
Data is retained for up to 30 days after cancellation to allow you to export your data. After that period, your data may be permanently deleted.
Billing records
Retained for a minimum of 7 years as required by applicable financial regulations.
Legal holds
If your data is relevant to pending or anticipated litigation, we will retain it for the duration of the legal matter.

You may request deletion of your personal information at any time by contacting us at [email protected]. Note that we may be required to retain certain data even after a deletion request to comply with legal obligations.

10Your Privacy Rights

Depending on where you are located, you may have the following rights regarding your personal information:

Access & Portability
Request a copy of the personal information we hold about you, in a commonly used format.
Correction
Request that we correct inaccurate or incomplete personal information.
Deletion
Request that we delete your personal information, subject to certain exceptions (such as legal obligations).
Objection & Restriction
Object to or request that we restrict certain processing of your personal information.
Opt-Out of Marketing
Unsubscribe from marketing emails at any time using the unsubscribe link in any email, or by contacting us directly.
Withdraw Consent
Where processing is based on your consent, withdraw that consent at any time without affecting the lawfulness of prior processing.

11California Residents — CCPA Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights regarding your personal information.

11.1 Right to Know

You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it.

11.2 Right to Delete

You have the right to request deletion of personal information we have collected from you, subject to certain exceptions.

11.3 Right to Opt-Out of Sale

We do not sell your personal information as defined by the CCPA, and we have not done so in the preceding 12 months. You do not need to take any action to opt out of the sale of your data.

11.4 Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, or provide you with a different level of quality because you exercised your privacy rights.

11.5 Authorized Agent

California residents may designate an authorized agent to submit a CCPA rights request on their behalf. To use an authorized agent, the agent must provide written proof of your authorization, and we may also require you to verify your own identity directly with us before processing the request. 11.6 How to Submit a Request

To submit a verifiable consumer request under the CCPA, contact us at [email protected]. We will verify your identity before processing your request and will respond within 45 days as required by the CCPA.

12Children's Privacy

The Floor Nexus Platform is not directed to individuals under the age of 18 and is intended solely for use by flooring industry professionals, vendors, and adult property owners. We do not knowingly collect personal information from anyone under 18 years of age. If you believe we have inadvertently collected personal information from a minor, please contact us immediately at [email protected] and we will take prompt steps to delete that information.

13Third-Party Links and Integrations

The Platform may contain links to third-party websites, tools, or services — including QuickBooks, Google Calendar, and payment processor dashboards. These third parties have their own privacy policies that govern the collection and use of your information on their platforms. Floor Nexus is not responsible for the privacy practices or content of any third-party site or service. We encourage you to review the privacy policies of any third-party service you connect to or interact with through our Platform.

14International Data Transfers

Floor Nexus is headquartered in Jacksonville, Florida, USA. Your information is stored and processed in the United States. If you access the Platform from outside the United States, your information will be transferred to and processed in the U.S., where data protection laws may differ from those in your country. By using the Platform, you consent to this transfer. Where required, we will implement appropriate safeguards — such as standard contractual clauses — to protect your information in accordance with applicable law.

15Changes to This Policy

We may update this Privacy Policy at any time to reflect changes in our practices, technology, legal requirements, or business operations. If we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, sending you an email notification or in-app alert. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
